Please read these Terms and Conditions carefully before purchasing from or interacting with MiksResin. By placing an order, browsing our website, or communicating with us via WhatsApp, Instagram, or email, you agree to be bound by these Terms and Conditions.

MiksResin is a sole proprietor business operated by Maike Fry, a handcraft resin and wood artist based in Durban, South Africa.


1. General

These Terms and Conditions govern all sales, orders, and interactions between MiksResin (“we”, “us”, “our”) and you, the customer (“you”, “your”).

We reserve the right to amend these Terms and Conditions at any time. The version in effect at the time of your order will apply to that transaction. We encourage you to review these Terms periodically.

These Terms and Conditions are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”).


2. Products

All products sold by MiksResin are handcrafted, one-of-a-kind pieces made from epoxy resin and natural wood. As a result:

  • No two pieces are identical. Variations in colour, grain, texture, and finish are inherent to the nature of handmade resin and wood art and are not considered defects.
  • Product photographs displayed in our WhatsApp catalogue and on our website are as accurate as possible, but colours may appear slightly different depending on your device’s screen settings.
  • Once a piece is sold, it cannot be reproduced exactly. We can create similar pieces in colours or styles of your choosing, but an identical duplicate is not possible.

We reserve the right to update or discontinue any product or collection without prior notice.


3. Ordering

3.1 How to Order

All orders are placed via WhatsApp by contacting us at +27 84 446 9393. You may browse the available catalogue through our WhatsApp catalogue feature and message us to place your order or make an enquiry.

3.2 Order Confirmation

An order is only confirmed once we have acknowledged it in writing via WhatsApp or email and you have made the required payment or deposit. We reserve the right to decline any order at our discretion.

3.3 Custom Orders

We welcome custom orders and commissions. For custom pieces:

  • A non-refundable deposit of 50% of the agreed price is required before work commences.
  • The remaining balance is due before dispatch or collection of the finished piece.
  • Custom orders are made to your specifications and cannot be returned or exchanged unless they are defective.
  • Production timelines for custom orders will be agreed upon at the time of order confirmation and may vary depending on complexity and current workload.

3.4 Availability

All items in our WhatsApp catalogue are available at the time of listing. Because each piece is unique, availability is on a first-come, first-served basis. We cannot guarantee availability between the time you view the catalogue and the time you place your order.


4. Pricing and Payment

4.1 Pricing

All prices are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable. Prices are subject to change without notice. The price applicable to your order will be the price confirmed at the time of order.

4.2 Payment Methods

We accept the following payment methods:

  • EFT (Electronic Funds Transfer) to our South African bank account
  • Instant EFT via secure payment platforms (where available)
  • Other payment methods as agreed in writing

Payment details will be provided upon order confirmation. We do not accept cash on delivery.

4.3 Payment Terms

For standard (ready-made) orders, full payment is required before dispatch. For custom orders, a 50% deposit is required before commencement, with the balance due before dispatch or collection.

Orders will not be processed or dispatched until payment has been received and confirmed.


5. Delivery and Shipping

5.1 Delivery Areas

We deliver throughout South Africa. Delivery to international destinations may be arranged upon request and will be subject to additional charges and conditions.

5.2 Delivery Costs

Delivery costs will be quoted at the time of order based on your location, the size and weight of the item, and the courier service used. Delivery costs are for the customer’s account unless otherwise agreed in writing.

5.3 Delivery Timeframes

We aim to dispatch ready-made orders within 3 to 5 business days of payment confirmation. Delivery timeframes thereafter depend on the courier and your location. We will provide you with tracking information once your order has been dispatched.

Timeframes are estimates only and are not guaranteed. MiksResin is not liable for delays caused by courier services, public holidays, force majeure, or events outside our reasonable control.

5.4 Risk and Ownership

Ownership of and risk in the goods passes to you upon delivery to the courier. We will take reasonable care in packaging items to minimise the risk of damage in transit. If an item arrives damaged, please refer to clause 7 (Returns and Refunds) below.

5.5 Collection

Local collection from Durban may be arranged by prior agreement. A specific time and location will be confirmed via WhatsApp.


6. Care and Use of Products

Our resin and wood pieces are functional artworks and should be treated with care to preserve their quality and longevity. We provide care instructions with each purchase. Please note:

  • Cheese boards and cutting boards should be hand-washed only. Do not submerge in water or place in a dishwasher.
  • Avoid prolonged exposure to direct sunlight, which may affect the colour and integrity of the resin over time.
  • Use of food-safe mineral oil or cutting board oil is recommended to maintain the wood component.
  • Resin surfaces may scratch if used with very hard or sharp implements directly on the resin portion. Use with care.

MiksResin is not liable for damage caused by failure to follow care instructions or misuse of products.


7. Returns, Exchanges, and Refunds

7.3 your rights

Nothing in these Terms and Conditions limits or excludes your statutory rights under the Consumer Protection Act 68 of 2008. Where applicable, you are entitled to return goods and receive a refund, replacement, or repair in accordance with the CPA.

7.2 ready-made products

Because each piece is handcrafted and one-of-a-kind, we do not accept returns or exchanges simply because you have changed your mind. We encourage you to view the WhatsApp catalogue carefully and ask questions before placing your order.

However, if a product arrives damaged or is materially defective (i.e. not caused by your misuse), please notify us within 48 hours of receipt by sending a message and photographs to +27 84 446 9393 or mikki@miksresin.co.za. We will assess the situation and, at our discretion, offer a repair, replacement, or refund.

7.3 Custom Orders

Custom orders are made to your specific instructions and are non-refundable and non-exchangeable, except where the finished product is materially defective through no fault of your own. The deposit paid for custom orders is non-refundable in all circumstances once work has commenced.

7.4 Goods in Transit

If your order arrives damaged due to transit, please photograph the packaging and the item immediately and notify us within 48 hours of delivery. We will assist in lodging a claim with the courier and assess an appropriate remedy.

7.5 Refund Processing

Where a refund is approved, it will be processed via EFT to your South African bank account within 7 to 10 business days of the approved refund date.


8. Intellectual Property

All content on the MiksResin website, WhatsApp catalogue, and Instagram account — including photographs, designs, videos, text, and artwork — is the intellectual property of MiksResin and Maike.

You may not reproduce, copy, distribute, or use any of our content for commercial purposes without our prior written consent. Sharing our content on social media for non-commercial purposes (e.g. tagging us in posts about a purchase) is welcome and appreciated.

The designs and techniques used in our products are original and proprietary. We do not permit copying or reproduction of our designs.


9. Limitation of Liability

To the maximum extent permitted by applicable South African law:

  • MiksResin’s total liability to you for any claim arising from a purchase or interaction with us shall not exceed the purchase price paid for the relevant product.
  • We are not liable for any indirect, incidental, or consequential loss or damage arising from the use of our products or website.
  • We are not liable for any loss or damage arising from events beyond our reasonable control, including but not limited to courier delays, load shedding, natural disasters, or pandemics.

Nothing in these Terms and Conditions limits our liability for death, personal injury caused by our negligence, or any other liability that cannot be excluded under South African law.


10. Website Use

Our website at www.miksresin.co.za is provided for informational purposes. While we endeavour to keep it up to date and accurate, we make no warranties as to the completeness, accuracy, or fitness for any particular purpose of the content on our website.

We are not liable for any loss or damage arising from your reliance on information contained on our website or from any interruption in access to the website.

Links to third-party websites (including WhatsApp and Instagram) are provided for convenience only. We are not responsible for the content or practices of those sites.


11. Communications and Marketing

By contacting us via WhatsApp or email, you consent to receiving communications from us relating to your order. We will not send you unsolicited marketing communications without your consent.

If you wish to stop receiving communications from us, please notify us at mikki@miksresin.co.za and we will action your request promptly.


12. Dispute Resolution

In the event of a dispute arising from these Terms and Conditions or any transaction with MiksResin, we encourage you to contact us directly in the first instance so that we may attempt to resolve the matter amicably.

If a dispute cannot be resolved directly, it may be referred to the National Consumer Commission or another appropriate dispute resolution body under the Consumer Protection Act.

These Terms and Conditions are governed by the laws of the Republic of South Africa, and any unresolved disputes shall be subject to the jurisdiction of the South African courts.
